The Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023

From 1 January 2024, amongst other changes, the first four weeks of a worker’s holiday pay must include:
- Payments, including any commission payments and performance related bonuses, closely linked to the performance of tasks which a worker is contractually obliged to perform.
- Payments for professional or personal status relating to length of service, seniority, and additional qualifications.
- Other payments, such as overtime payments which have been regularly paid to a worker in the 52 weeks of contract.
The remaining 1.6 weeks of statutory leave can but do not need to include these additions.
